Intellectual property and public agricultural research sector: some remarks

Abstract

The article attempts to provide some elements of historical retrospective of the industrial patents and plant breeder's rights. It also evaluates the possible evolution of the Brazilian Sistema Cooperativo de Pesquisa Agropecuária - SCPA (Cooperative Agricultural Research System) under the influence of the adoption of a Breeder's Rights Act, taking in account the consequences of this Act on countries like U.S.A. and England. As a final point, it indicates the potential impacts on Embrapa's performance and suggests some points that should be discussed to adequate its strategies to the new relations between the public and private sectors in R&D.
