O TRABALHO DO PESQUISADOR APÓS A REGULAMENTAÇÃO DO CONHECIMENTO CIENTÍFICO

Resumen

Assumindo que a sociedade se organiza por meio do trabalho intelectual, o conteúdo da lei que regulamenta o conhecimento científico é interpretado por intermédio do trabalho do pesquisador/ inventor. O artigo analisa as contradições da lei que regulamenta a propriedade intelectual no Brasil, identificando as possibilidades de apropriação e de exclusão em relação ao produto do trabalho intelectual, especialmente quando requer a titularidade da invenção. Sob as formas de implementação da lei, demonstra-se que o pesquisador e o sistema de C&T poderão ser os maiores perdedores.

THE RESEARCH ACTIVITIES AFTER NEW REGULAMENTATION IN SCIENCE AND TECHNOLOGY
ABSTRACT
Under the presupposition that the intellectual labor organizes the societies, the law content for the scientific knowledge regulation is analyzed through the researcher's work. The article's goal is to analyze the Law's contradictions, identifying its implications to the expropriation and exclusion of the intellectual labor in relation to its product, specially when requiring the proprietary title. Considering the Law implementation, it is shown that the researchers and the S&T system will be the losers.
